Terms and Conditions
  1. Only bookings cancelled at least 30 days before booking dates by way of E-mail to info@simchalodge.co.za can be refunded subject to management approval.
  2. We do not take a deposit for unforeseeable damages but we do ask our guests to report any breakages i.e. glasses, plates, linen, etc so that they may be replaced for our next guest’s arrival. Any breakages will be invoiced to the party concerned and will be deducted from your payment method without prior notice.
  3. The Guest receives 1 set of/house/gate keys for duration of the rental period. A set of house and gate keys will incur a replacement charge if lost or not returned.
  4. Any valuables left at the property are left at your own risk. We are not responsible for their loss and therefore recommend that you take out the appropriate personal travel insurance.

Liability and Responsibilities of the Guests

The rental property including the furniture and the other contents are to be treated with care. The Guest is held responsible for the actions of other people in their party, including any guests or visitors they may have, within the house. The Guest is liable for any damaged goods, damage to the property or damage to anything else related to the property (e.g. swimming pool), whether caused by themselves or their accompanying guests or visitors. The Guest acknowledge the lodge is in good repair in the event nothing is reported within the first 12 (twelve) hours of them arriving at the lodge.

Swimming Pool

We want you to enjoy our swimming pool but please note that you use the swimming pool at your own risk and discretion. Diving is not permitted. You should check the water depth before using it. Do not use the pool if you are under in influence of alcohol. Please do not take breakable glasses into the pool area. Please take care when the tiles are wet and be sure to supervise any children around the pool.

Smoking Policy

We ask that our guests refrain from smoking inside the lodge. There are Maxibins provided on the patio downstairs.

Force Majeure: 

This means that we cannot pay compensation on any situation outside our control such as war or threat of war, riot, industrial dispute, technical or maintenance problems with means of transportation, rescheduling or cancellation of flights by an airline or main charterer, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions or any other unforeseen circumstances that amount to Force Majeure. We do not accept responsibility for you or your party if you contravene any law or regulation of any country visited during your holiday.

No Pets are allowed in Marloth Park.
Owners are allowed to visit the property at anytime.
Please ensure doors are locked, windows are closed and alarm armed when not on the property.

Please ensure that the back door is locked when sitting in the front of the house on the patio.

  1. Inventory must be checked by occupier upon arrival and should notify the owners, in writing, of any discrepancies.
  2. If any items found to be out of order, same must be reported to the owners in writing, no later than 24 hours of arrival, failing which, such items shall be deemed to be in working order. Any damage due to misuse will be for the account of the occupier. If any items are found to be out of order, please also report these to the owners in writing.
  3. Plumbing, electrical or such like problems must be reported to the owners who shall arrange repairs. If such problem is in the opinion of the contractor, caused by the occupier, (then the occupier) shall be liable for the account to repair.
  4. Whilst every effort is made to ensure the stability of water and electricity, there may be some instances where this is out of our control and the owners cannot be held liable for these disruptions.
  5. The pool is used at the occupier’s own risk and discretion. The owners shall not be held responsible for any injury or death sustained in or around the pool.
  6. The water may not be safe to drink, please use the water machine.
  7. During the occupier’s stay in the lodge, the occupier shall keep the premises, content and surrounds in good order and condition.
  8. The occupier shall not code nor assign this agreement in whole or part, nor shall he/she sub-let the lodge or any portion thereof. The number of occupants shall be approved at the discretion of the owners and at an additional charge.

The occupier hereby chooses domicllium citandi et executandi for his/her address as stated in the booking form and accepts the jurisdiction of the Magistrates Court Johannesburg for any disputes and further agrees that he/she shall be liable for any legal costs incurred in respect of any action instituted against him/her on their attorney and client basis including the collection commission.
